This agreement is concluded between Bal Host (operator: Duhan Berk BAL) and the natural or legal person ("Customer") obtaining services via www.balhost.net.tr.
The following clauses apply to all IT services.
1. Parties and Subject Matter
This agreement is concluded between Bal Host (operator: Duhan Berk BAL) and
the natural or legal person ("Customer") obtaining services via the Bal Host website (www.balhost.net.tr).
It covers the terms of use for all IT services, including VDS/VPS (virtual servers), physical (dedicated) servers, colocation, software, licensing, backups, IP leasing, and similar services.
This agreement consists of 7 (seven) pages in total.
2. Acceptance
By obtaining services from Bal Host, the Customer declares that:
- they have read this agreement,
- they understand all technical and legal terms,
- they have sufficient information about the nature of the service.
3. Order, Provisioning and Delivery
- Orders are processed after payment is completed and fraud checks are carried out.
- With card payments, virtual servers are usually provisioned automatically within minutes.
However, for technical or security reasons provisioning may take up to 24 hours. For other services, provisioning may take up to 72 hours. - For bank transfer/EFT payments, payment confirmation may take up to 1 business day.
- Unless stated otherwise, software and licence services are delivered within 7 days at the latest.
- If delivery does not occur within these periods, a refund will be made upon the Customer's request.
4. Customer Information and Notices
- The Customer is responsible for the accuracy of all information provided during order and registration.
- An actively used email address and phone number must be provided.
- All emails and SMS messages sent by Bal Host are deemed received by the Customer.
- Bal Host is not liable for consequences arising from failure to keep account contact details up to date
or from inactive notification permissions. - Notices via the customer panel, responses via support tickets, and notices sent to registered communication channels
are deemed valid notices.
5. Payment, Renewal and Suspension
- Bal Host operates on a prepaid service model.
- If the renewal invoice is not paid, the service is held in suspension for 3 days.
- If payment is not made after 3 days, the service is permanently deleted and cannot be restored.
- Bal Host reserves the right to change service prices without prior notice due to inflation, energy, licence, hardware, or supply cost changes.
- Price changes apply at renewals after the end of the current service period.
- Bal Host reserves the right, without stating reasons, not to enter a service relationship with a customer, to reject an order, or to terminate an existing service.
- Bal Host has the sole right, based on operational, technical, commercial, or risk assessments,
to decide customer selection and whether to continue a service.
6. Cancellation and Refunds
- Service cancellation is only performed via the customer panel.
- Refund requests for unresolved technical issues attributable to Bal Host are assessed with regard to the cause and actual use of the service.
- Refunds are made to the bank account or card used for payment.
- VAT and bank fees may be deducted from the refund amount.
- For domains, licences, software, custom configurations, manual provisioning, services involving third-party supply, and promotional/discounted services,
cancellation, statutory withdrawal (where applicable), and fee refunds do not apply.
7. Server Use
7.1. General use
- All data, software, and configuration on the server are the Customer's responsibility.
- Unless otherwise agreed in writing, all server services are provided as "unmanaged".
Management, updates, security, and continuity of the operating system, control panel, applications, services, databases, security settings, user actions, and all software components are the Customer's responsibility.
7.2. Licences and software
- Licensing the operating system and third-party software is the Customer's responsibility.
- Bal Host is not liable for legal or technical consequences of unlicensed software use.
- All damages from IP blacklisting due to unlicensed use are borne by the Customer.
7.3. Resource use
- For VDS services, a fair-use limit of 1 GHz per purchased CPU core applies.
- Example: 8 cores = 8 GHz (8000 MHz).
- Hardware resource overuse that may affect other services is prohibited.
- Dedicated servers are delivered with Core Performance Boost (CPB) disabled by default.
Upon Customer request, CPB may be enabled for an additional fee. Monitoring thermal behaviour after enabling CPB is the Customer's responsibility. - If use is detected that harms infrastructure stability, network performance, or service quality for others, Bal Host may,
without prior notice, reduce port speed, limit resources, suspend the service temporarily, or terminate it. - Resource assessments are based on Bal Host's technical measurements and system logs.
7.4. IP change policy
- One IP change may be granted based on technical reasons stated by the Customer.
- Bal Host may charge a fee for IP changes.
7.5. Operating system installation
- On virtual servers, OS images installed automatically via the panel may be reinstalled up to 15 times within 30 days.
For manually installed OS images, the first installation request at order time is free. - On physical servers, the OS is installed manually; the first installation request at order time is free.
- Fees may apply for exceeding limits or additional reinstall requests.
7.6. SMTP / mail policy
- SMTP ports are closed by default.
- For outbound mail, a support ticket must be opened and policy terms accepted.
- If use suggests spam, abuse, blacklisting, phishing, malicious traffic, or bulk mail, Bal Host may,
close relevant ports, stop IP announcement, suspend, or terminate the service. - Bal Host is not liable for indirect losses such as access loss, delivery issues, revenue, or reputation arising from these measures.
7.7. Security policy
- Bal Host may take technical and administrative action without prior notice in cases such as abuse reports, legal requests, security risks, spam, attacks, malicious traffic, unauthorised access attempts, use threatening infrastructure integrity, or other exceptional situations affecting other customers.
Such action may be taken without prior notice. - This may include suspending, restricting, or shutting down the service, stopping IP routing or announcement, closing ports, limiting access, or fully terminating the service.
- In such cases Bal Host has no obligation to obtain prior approval, hand over data, or keep the service active.
8. Traffic and fair use
- Servers have symmetric physical connectivity of at least 1 Gbit/s and up to 10 Gbit/s.
- Bal Host is not liable for different speed-test results due to infrastructure factors.
- "Unlimited traffic" means usage under the service is not measured in TB and no quota is applied under normal operation.
No quota applies at any point under normal operation. - Unused traffic does not roll over to the next period.
- Excess use may be billed additionally.
9. DDoS protection
- DDoS protection aims to protect Bal Host's internet backbone and overall infrastructure integrity.
- The Customer accepts that complex attacks, force majeure, or operator-related outages and access issues may occur.
10. Backups and data loss
- Virtual server services include automatic backups by default.
- On physical servers, backups may be included with an additional order.
- Even if backups are taken by us, integrity and correctness are not manually verified;
Bal Host cannot be held liable for resulting damages. - The Customer must maintain their own backups.
- Accounts and backups more than 3 days past payment are permanently deleted.
- Bal Host is not liable for data loss due to disk failure, RAID issues, filesystem errors, corruption, software errors, user actions, malware, or third-party intervention.
- Bal Host provides no data recovery guarantee under any circumstances.
11. Support scope
- Support is provided only via the customer panel.
- Liability within the service scope is limited to continuity of the physical infrastructure.
- 24/7 support does not mean an instant response guarantee.
- Except in exceptional cases, response time does not exceed 24 hours.
12. Prohibited content and lawful use
- DDoS, spam, proxy, erotic/pornographic content, illegal software, mining, brute force, and illegal streaming/broadcasting are prohibited.
- If detected, the service may be stopped or terminated.
- Where necessary, competent authorities may be notified.
- Bal Host may suspend services without prior notice where content or activity is suspected to be unlawful, risks system security, or affects other customers.
Suspension may occur without prior individual notice in such cases.
13. Limitation of liability
- Except in cases of intent or gross negligence, Bal Host is not liable for any indirect damages.
- Any total liability of Bal Host is limited to the amount paid by the Customer for the relevant service in the last invoiced period.
13.1. Hardware failures and supply times
- Delays may occur on dedicated servers due to hardware failures.
- Bal Host is not liable for indirect damages from component replacement lead times.
13.2. Force majeure
- Natural disasters, fire, earthquake, war, terrorism, civil unrest, strikes, cyber attacks, operator outages, data centre failures, power outages, and similar events constitute force majeure.
- Bal Host cannot be held liable in force majeure situations.
14. Changes to this agreement
- Bal Host reserves the right to change these terms without prior individual notice.
- Changes take effect from the date they are published on the website.
15. Records and evidentiary agreement
- Bal Host system, traffic, billing, support, log, and electronic records
are accepted as evidence.
16. Jurisdiction
For disputes arising from this agreement,
the courts and enforcement offices of Istanbul Anatolia (Anadolu) on the Asian side of Istanbul have jurisdiction.
